By ticking the acknowledgement presented when registering for an Event or claiming a Giveaway, the Attendee confirms that they have read, understood and accepted these terms. Where an Event does not require registration or a claim, these terms apply to the Attendee's use of the Platform to discover and attend that Event. These terms constitute a binding agreement between the Attendee and HeadsUp (Pty) Ltd, registration number 2025/560337/07 ("HeadsUp").
"Platform" means the HeadsUp website, portal and associated channels.
"Event" means a happening at a specific place during a particular period of time that is listed on the Platform by an Organiser. An Event may take any form, including a business offer, a service, a special, an activity, an availability or a gathering, and may be free or ticketed. An Event need not involve a ticket, registration or Giveaway, and may consist only of a listing with a location and directions.
"Organiser" means any party that posts an Event or Giveaway, including a business owner, an employee or representative of a business, a promoter or a partner, whether acting on their own behalf or with the authority of the party responsible for the Event.
"Giveaway" means any prize, ticket, promotional competition or upskilling opportunity offered through the Platform.
"Prize" means anything offered under a Giveaway.
"Attendee" means any person who views, registers for, claims or attends an Event or Giveaway.
The Platform is a discovery and listing service. HeadsUp does not organise, host or conduct any Event or Giveaway, does not operate any venue, and does not supply any Prize. Each Event and Giveaway is the sole responsibility of its Organiser. Content relating to an Event or Giveaway is supplied by the Organiser, and HeadsUp does not warrant that such content is accurate, complete or current.
Event details, including times, pricing and availability, are set by the Organiser or venue and may be varied or cancelled by them at any time. HeadsUp is not responsible for any such variation or cancellation, or for any cost or loss incurred by the Attendee in reliance on a listing. The Attendee is advised to confirm details with the Organiser or venue before attending.
The Attendee attends any Event voluntarily and at the Attendee's own risk. Attendance is subject to the terms of the Organiser and the rules of the venue, including the venue's rights of admission, under which admission may be refused or withdrawn. The Attendee is responsible for their own safety and belongings and for compliance with all Organiser and venue rules.
Where the Attendee claims a Giveaway or receives a ticket or Prize, the following conditions apply unless the Organiser's published rules provide otherwise. Each Prize: is not transferable to any other person and may not be transferred to another date; carries no cash value and is not redeemable for cash; is subject to availability and may be limited to one per person; is forfeited if not claimed or redeemed by the stated time or date; and remains subject to the venue's rights of admission, such that a ticket or Prize does not guarantee entry. The Attendee may be required to verify their identity in order to claim. Each Prize is provided by the Organiser or partner and not by HeadsUp, and any query concerning a Prize is to be directed to the Organiser.
To the maximum extent permitted by law, HeadsUp shall not be liable for any loss, damage, injury or death arising from any Event, Giveaway or Prize, or from the Attendee's reliance on any listing. Nothing in these terms excludes or limits any right of the Attendee that may not lawfully be excluded or limited, including under the Consumer Protection Act, 2008.
In order to register for an Event or claim a Giveaway, the Attendee may be required to provide personal information, such as their name and contact details. HeadsUp processes such information in accordance with its Privacy Notice. Where an Organiser collects the Attendee's personal information in connection with an Event or Giveaway, the Organiser is responsible for that information and for its use.
