Please read these Terms of Service ("Terms") carefully before using the Nudge AI mobile application (the "App"), web quiz, or web membership checkout operated by BERG LLC ("we," "our," or "us").

By downloading, installing, or using the App, or purchasing a web membership, you agree to be bound by these Terms. If you do not agree to these Terms, do not use these services.

1. Description of Service

Nudge AI is a productivity application that helps you stay focused while using potentially distracting apps. The App offers two modes:

Timer Mode (Free)

• Available to all users at no cost
• Simple countdown timer that blocks selected apps for a set duration
• No screen analysis or AI processing
• Timer Mode captures no screenshots and uses no AI screen analysis. Authentication, purchase checks where applicable, Live Activity updates, analytics, and paywall services can still communicate with our servers and providers — see our Privacy Policy.
• Unlimited usage

Task Mode (Pro Feature)

• Requires an active Pro subscription or an eligible trial
• Uses screen broadcasting to capture your screen during focus sessions
• Uses AI-powered analysis (via Google Gemini) to determine if you're staying on task with your stated task
• Subject to usage limits based on your subscription tier

Both modes use Apple's Screen Time APIs to display blocking screens on selected apps.

Service Evolution: We are constantly working to improve and expand the App. We reserve the right to add, modify, or remove features and functionalities at any time, including but not limited to additional blocking methods, new focus-enhancing tools, or alternative monitoring technologies. For material changes that negatively affect your use, we will provide reasonable notice as described in Section 14.
