These Terms of Service ("Terms") are a binding agreement between you ("you" or "your") and Zoomies Training, Inc., a Delaware corporation doing business as Scout ("Scout," "we," "us," or "our"). They govern your access to and use of our website, our email list, and any free resources we make available (together, the "Services").
By accessing or using the Services, or by subscribing to our email list, you agree to be bound by these Terms. If you do not agree, do not use the Services.
We may revise these Terms at any time by posting an updated version and changing the "Last updated" date above. Your continued use of the Services after the revised Terms take effect constitutes your acceptance of them.
You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. The Services are intended for adults and are not directed to children.
The Services currently consist of our website, our email list, and free educational materials concerning dog training and dog reactivity. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
The materials provided through the Services (the "Content") are general educational information only. They do not constitute professional training, behavioral, or veterinary advice for your individual dog, and they are not a substitute for in-person evaluation and treatment by a qualified trainer, behaviorist, or veterinarian.
You acknowledge that we have no knowledge of your dog and cannot assess your dog through the Services, that every dog and situation differs, and that we make no representation or warranty that any Content will produce any particular result.
You acknowledge that interacting with and training dogs involves inherent risks, and that these risks are greater with dogs that are reactive, fearful, or aggressive. Such risks include, without limitation, bites and other injuries to you, your dog, other people, and other animals.
You knowingly and voluntarily assume all such risks. You are solely responsible for your dog's behavior, for your own safety and the safety of others, and for deciding whether and how to apply any Content. You are solely responsible for complying with all laws applicable to you and your dog, including leash, muzzle, containment, and liability laws.
You acknowledge that in-person professional help and veterinary consultation are appropriate where your dog has bitten or injured a person or animal, or shows signs of aggression, fear, or distress, and that you are responsible for obtaining them before relying on any Content.
To the fullest extent permitted by law, you release Scout and its officers, employees, and contractors from any claim, demand, liability, loss, or injury arising out of or relating to your use of the Services or your training, handling, or management of your dog.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not misuse the Services, interfere with their operation, attempt to gain unauthorized access to them, or use them to infringe the rights of, or cause harm to, any person.
The Services and the Content, including all text, images, video, downloadable materials, and the Scout name and logo, are owned by or licensed to Scout and are protected by intellectual property laws. We grant you a limited, personal, non-commercial, non-transferable, and revocable license to access and use our free resources for your own use.
