These Terms of Use and End-User License Agreement (the “Terms”) govern your download, installation and use of any mobile application published by Mobi-net Paweł Lewiński that displays or links to these Terms (each an “App”, together the “Apps”), including free features, paid downloads, in-app purchases and subscriptions.
Please read these Terms before using an App. By downloading or using an App, you agree to these Terms. If you do not agree, do not use the App.
The exact name, functions, compatibility, paid benefits, subscription title, billing period and current price for a particular App are displayed in that App and its store listing or purchase screen. An App-specific notice supplements these Terms and takes priority for the feature or offer it expressly describes.
These Terms govern licensing, purchases, subscriptions, cancellations, refunds, warranties and liability. The handling of personal data is governed separately by our Privacy Policy, available in the App and its store listing.
The Apps are provided and licensed by:
Mobi-net Paweł Lewiński Paweł Lewiński, sole trader Wolnościowa 8 95-200 Pabianice Poland NIP (Tax ID): 7311466336 REGON: 472151408 Email: [email protected] Telephone: +48 662 555 199
In these Terms, “Provider,” “we,” “us” and “our” refer to the business identified above. “You” means the person using an App.
These Terms are concluded between you and the Provider, not Apple or Google. The Provider is responsible for the App and its content, subject to the platform-specific provisions below.
Your use of an App is also subject to the rules that apply to the account and store from which you obtained it, including the Apple Media Services Terms and Conditions or Google Play Terms of Service.
If you obtained an iOS App through the Apple App Store, Apple’s standard Licensed Application End User License Agreement may also apply to it. Where that agreement and these Terms differ, the provision more favourable to you as a consumer applies, without prejudice to Section 20.
If these Terms conflict with mandatory applicable law or a mandatory platform usage rule, the mandatory law or rule prevails.
You may use an App only if you have legal capacity to enter into these Terms. If you are under the age at which you can enter into a binding agreement or make a purchase in your country, a parent or legal guardian must review and accept the relevant terms and authorise any purchase.
Some optional features process personal data on the basis of your consent. If you are below the age at which you can give that consent yourself under the law of your country (in the European Union this is between 13 and 16 years), such a feature is available only with the consent of a parent or legal guardian and otherwise remains switched off.
Nothing in these Terms excludes or limits rights that a consumer cannot waive under the law of Poland, the European Union, the European Economic Area, the United Kingdom or another applicable jurisdiction.
Depending on the particular App, its functions may include timers, reminders, local history and statistics, weather information, location-based information, maps, activity measurements, characters, visual or audio content, sharing, widgets or other functions described in the App and store listing.
